These Terms & Conditions ("Terms") apply to all photography and related content services provided by Grainy Tones ("Photographer") to any client ("Client"). By confirming a shoot date in writing (email/message) and paying the deposit, the Client confirms that they have read and agreed to these Terms.
1. Scope of Work
1.1. The Photographer provides fashion, lookbook, campaign and brand content photography, and may provide video/motion deliverables when agreed.
1.2. Specific details for each project (date, location, duration, rates, estimated number of looks and edited images, usage scope, delivery time) are outlined in a separate Proposal / Booking Confirmation / Invoice ("Project Summary").
1.3. If there is any conflict between these Terms and the Project Summary, the Project Summary prevails with respect to rates, dates, deliverables, delivery time and usage scope.
2. Booking and Time on Location
2.1. A shoot date is considered reserved only after the Client has:
confirmed the booking in writing (email or messenger), and
paid the agreed deposit stated in the Project Summary.
2.2. The Photographer works in time blocks (e.g. half day / full day). Time on location includes makeup and hair, styling and preparation, light setup, and reasonable technical breaks.
2.3. The number of looks (outfits/sets) and the number of edited images included are specified in the Project Summary.
2.4. Overtime (time beyond the booked block) is subject to availability and is billed at the pro-rated hourly rate of the booked package, rounded up to the next 30 minutes, unless otherwise stated in the Project Summary.
3. Rates and Payment
3.1. All rates and any add-ons (extra looks, additional edited images, beauty retouch, RAW buyout, usage extension, production support, etc.) are stated in the Project Summary and/or invoice.
3.2. To secure the date, the Client pays a non-refundable deposit (percentage or fixed amount specified in the Project Summary).
3.3. The remaining balance must be paid within the timeframe indicated in the Project Summary (for example, on shoot day or within 5 calendar days after the shoot), unless otherwise agreed in writing.
3.4. Additional services requested after the shoot (extra looks, extra edited images, deep beauty retouch, usage extension, etc.) are invoiced separately and must be paid before delivery of the corresponding files.3.5. Bank/transfer fees (if any) are the responsibility of the Client.
4. Image Selection and Deliverables
4.1. The Photographer performs an initial technical and creative selection, removing obvious rejects (out of focus, closed eyes, test frames, etc.) and keeping only strong images that match the agreed style.
4.2. The Client receives preview images (JPEG, with basic color correction) representing the best results from the shoot. The number of previews is not strictly limited and depends on the project, but typically includes several strong variations per look.
4.3. From the previews, the Client selects images for final editing up to the amount specified in the Project Summary.
4.4. Additional fully edited images beyond the agreed package are available for an extra rate, as stated inthe Project Summary or current price list.
4.5. Final images are delivered in high-resolution JPEG (and optionally web-optimized JPEG) via online gallery or download link within the delivery timeframe stated in the Project Summary.
4.6. Unless otherwise agreed, the Photographer archives delivered files for 30 days after delivery. Re- delivery after that period may be subject to a handling fee.
5. Editing, Retouching and Makeup
5.1. Standard editing (included in the package rate) typically covers:
color correction and toning,
exposure and contrast adjustments,
light skin clean-up,
light dodge & burn,
removal of small distractions (dust, minor artifacts).
5.2. Deep beauty retouch (heavy skin correction, fixing problematic makeup or uneven tan, complex body or garment reshaping, etc.) is not included in standard editing and is charged separately according to current retouching rates.
5.3. The Client is responsible for arranging models, styling, makeup and hair at the desired quality level. The Photographer is not responsible for aesthetic issues caused by lack of a professional makeup artist, low-quality makeup/hair, uneven tan, or skin conditions. Any requested correction of such issues in post-production will be billed as deep beauty retouch.
5.4. RAW/original files are not included and remain the property of the Photographer. If the Client wishes to obtain RAW files, this may be arranged as a separate buyout for an additional rate agreed in writing.
6. Cancellation and Rescheduling
6.1. Cancellation by the Client: the deposit is non-refundable. If the Client cancels within 72 hours of the scheduled start time, the Client may be charged up to 50% of the shoot rate. If the Client cancels within 24 hours, the Client may be charged up to 100% of the shoot rate. Any stricter or different policy stated in the Project Summary prevails.
6.2. Rescheduling by the Client: one reschedule may be allowed subject to availability if requested at least 7 days in advance. Rescheduling with less than 7 days notice may incur an additional fee or be treated as a cancellation, depending on timing and circumstances.
6.3. Cancellation/Rescheduling by the Photographer: if the Photographer is unable to perform due to illness, injury or other serious circumstances, the Client will be notified as soon as possible. The Photographer will offer a new date or refund amounts paid. This refund is the Client’s sole remedy.
7. Weather and Outdoor Conditions
7.1. For outdoor/location shoots, the Client acknowledges that weather may affect the look and feasibility of the shoot.
7.2. In case of severe or unsafe weather conditions (heavy rain, storm, unsafe conditions), the Photographer may suggest rescheduling or adjusting the concept. One reschedule due to objectively severe weather may be allowed without an additional rescheduling fee, subject to availability.
7.3. Cloudy weather, light rain, lack of "perfect sunset" or non-ideal sun position are not sufficient reasons for free cancellation.
8. Usage Rights (License)
8.1. The Photographer retains all copyright and moral rights to the images, unless explicitly transferred in a separate written agreement.
8.2. Upon full payment, the Client receives a non-exclusive, non-transferable license to use the final delivered images for the Client’s brand promotion within the scope (term, media, territory) specified in the Project Summary.
8.3. Any use beyond the agreed scope (extended term, print/OOH campaigns, third-party retailers, packaging, etc.) requires a separate written agreement and additional licensing rate.
8.4. Unless otherwise agreed in the Project Summary, the license does not include resale of the images, use by third parties, or transfer to another brand/entity.
9. Portfolio Use and Credits
9.1. Unless otherwise agreed in writing, the Photographer may use selected images from the project in their portfolio (website, social media, printed portfolio, presentations, etc.) and for self-promotion.
9.2. Where reasonable, the Client is encouraged to credit the Photographer (e.g. "Photo: Grainy Tones") in editorial or press contexts.
10. Governing Law and Disputes
10.1. These Terms are written in English.
10.2. These Terms are governed by the laws of the Republic of Indonesia. The Parties will first attempt to resolve any dispute amicably. If this is not possible, disputes shall be submitted to the competent courts of Denpasar, Bali, unless otherwise agreed in the Project Summary
